ACCEPTANCE OF TERMS THROUGH USE
By using this site, you signify your agreement to all terms, conditions, and notices contained or referenced herein. If you do not agree to these Terms of Use ("Terms ") please do not use this site. Newgenvehicles.com reserves the right to change these Terms, and your continued use of this Web site constitutes agreement to all such changes. Please check the Terms periodically for changes.

 

CUSTOMERS RESPONSIBILITIES AND LIMITATION OF LIABILITY
Customers purchasing from Newgenvehicles.com agree that their sole recourse for product liability shall be to the manufacturer of the Product(s) and/or a return of the Product(s) to Newgenvehicles.com pursuant to the Newgenvehicles.com return policy set forth on this website, as amended from time to time.
The products on this site are designed for recreational and/or for personal transportation of a single rider with proper safety equipment. Customers warrant and agree that they will operate Product(s) purchased from Newgenvehicles.com for their proper use, in a safe manner, and under normal operating conditions. Normal operating conditions require adherence to manufacturer's specifications in the owner's manual, and routine care and maintenance by the purchaser of the Product(s). Proper use means that the Product(s) are to be used only in the manner intended for personal transportation of a single rider with proper safety equipment on smoothly paved, safe, dry, non-oily surfaces in accordance with local regulations during daylight hours. The products on this site are designed for recreational and/or for personal transportation of a single rider with proper safety equipment. They are not suitable for handicapped persons or persons with limited mental or physical capacities. Customer is responsible for registering and operating the motor scooter in accordance with local and state laws and ordinances. Newgenvehicles.com makes no representations that the motor scooter is legal for operation in your city and state. It is the purchaser's responsibility to check all local laws and ordinances prior to purchasing a scooter.

DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY
The information, products and services on this Web site are provided on an "AS IS," and "AS AVAILABLE" basis. Newgenvehicles.com does not warrant the information or services provided herein or your use of this Web site generally, either expressly or impliedly, for any particular purpose and expressly disclaims any implied warranties, including but not limited to, warranties of title, non-infringement, merchantability or fitness for a particular purpose. Newgenvehicles.com will not be responsible for any loss or damage that could result from interception by third parties of any information or services made available to you via this Web site. WITHOUT WAIVING THE EXCLUSIVE GOVERNING LAW PROVISION SET FORTH HEREIN, SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THEREFORE THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, NEWGENVEHICLES.COM' LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
THE LIMITATION OF LIABILITY SET FORTH ABOVE SHALL APPLY TO EVERY FORM OF ACTION, WHETHER IN CONTRACT, WARRANTY, STRICT LIABILITY, NEGLIGENCE OR OTHER TORT, AND SHALL SURVIVE ANY BREACH OF THE TERMS OR ANY AGREEMENT, OR THE FAILURE OF THE ESSENTIAL PURPOSE OF THE TERMS OR AN AGREEMENT OR ANY EXCLUSIVE REMEDY.

Order Cancellation Policy:
Before completing your purchase, please confirm that you have selected the correct item(s), color(s), accessories, etc. Due to the high volume of orders, and the speed at which orders are processed, once an order is placed it is generally processed & shipped immediately therefore we have a NO cancellation policy after an order has been placed.
However, every effort will be made to cancel or modify an order which has been made if our order processing department at orders@newgenvehicles.net is contacted swiftly before the item(s) have been shipped. If we are unable to do so, you may return it as per our Return Policy.

MISPRICED PRODUCTS OR SERVICES

Since changes may be made due to the manufacturer without notice Newgenvehicles.com cannot guarantee that product descriptions/specifications, pricing, or any other content is accurate, complete, or current. Newgenvehicles.com shall have the right to refuse or cancel any orders placed for products listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. Newgenvehicles.com shall have the right to refuse/cancel any orders whether or not the order has been confirmed and your credit card charged. In the event of order cancellation after your credit card has been charged, Newgenvehicles.com shall provide an immediate credit refund to your credit card account for the total of the charge.

SHIPPING DAMAGE & DEFECTIVE PART(S) CLAIMS

Newgenvehicles.com strives to bring satisfaction to all customers by providing quality products from manufacturers who represent that their products are subjected to rigorous quality control inspection before shipment to ensure all desired standards are met and customers are satisfied. In the unlikely event that any of our customers receives damaged or defective merchandise from the manufacturer, Newgenvehicles.com has developed policies to protect you.
Step 1:
On delivery, if damage is noticeable, ensure carrier notes any damage before they leave.  Carefully examine your received items within 3 days of receipt. If shipping damage or a defective part is present, you must file a claim within three days of delivery.

Step 2:
To file a claim, please contact Technical Support Department within three days of delivery via the contact information listed at the bottom of your Shipping Notice. Claims of damage or defective part(s) upon delivery are resolved through the manufacturer since in most cases products are shipped directly from the manufacturer. A technical support representative will respond and troubleshoot the problem. Upon confirming that the problem is not caused by abuse, neglect or failure to follow instructions and to be a defective part or damage resulting from the initial shipments, technical support and replacement parts will be provided to satisfy the problem.

Step 3:
After filing your claim please contact Newgenvehicles.com at orders@newgenvehicles.net immediately in order for us to provide maximum assistance to provide speedy resolution of your claim by the manufacturer. Please continue to follow all service requests and instructions provided by the technical support.

Terms and Conditions: Due to the high volume of orders, and the speed at which orders are processed all sales are final. However Newgenvehicles.com, in our pursuit of 100% customer satisfaction, will assist in ensuring resolution of damaged and defective parts issues with the manufacturer on the customers behalf after the customer has filed a claim with the manufacturer within three days of delivery.

Damaged and defective parts will be replaced free of charge and free of shipping charge to the end user of the scooter. Technical support will be provided for installation of the replacement part for which installation is the responsibility of the customer. In some cases, it may be the responsibility of the customer to provide photographs or for certain original part(s) to be shipped back to the manufacturer before receiving replacement part(s). Cosmetic damage including small rubs, scratches, blemishes, oxidation, or wear marks can occasionally occur during shipping. Customer agrees to accept all products with cosmetic damage, which usually occurs during shipping, such as scratches and blemishes and through the filing of a claim support will be provided to address the respective part.
Newgenvehicles.com also provides the option of utilizing our return policy.
All defective and damage part(s) claims following the required procedure within the three day time frame will receive full assistance in the aim of resolution from Newgenvehicles.com.  In the event of failure of the customer to respond in a timely manner to service requests , the customer agrees that their sole recourse shall be to return the unused Product(s) to Newgenvehicles.com pursuant to our 30 day Return Policy, if applicable, or to pursue their claims directly with the manufacturer. Customer is not hereby waiving any rights against the manufacturer pursuant to the applicable manufacturer's warranty.

With failure to file a claim within three days of delivery, all damaged products purchased are exclusively subject to the terms of the manufacturer's warranty or claims against the shipper. For obvious damage caused during shipment, your claim may be placed with the respective shipping company after this three day period has expired.

30 DAY RETURN POLICY

All purchases made from Newgenvehicles.com are covered by a 30 day return policy and are subject to the below terms and conditions.

For return of merchandise purchases from newgenvehicles.com please follow the below steps.

 

We will contact you within 2 business days of submittal of this form and provide you with your R.M.A number, return mailing address and instruct you how you may proceed. All returns for refunds must be pre-authorised.

Return Terms and Conditions
Return shipping charges must be paid by Customer.
All returned products must be in re-sellable condition, the item must be packed up in the original shipping carton along with all accessories, manuals, parts etc. Products and packaging cannot be used, damaged or marked. To qualify for a return, items must be shipped within 30 days of the purchase date.


Items returned without pre-authorisation may be refused and, if accepted, items returned without RMA #’s will be subject to an additional 15% restocking fee. Newgenvehicles.com reserves the right to deny any return based on the above criteria and require the customer to pay return shipping and handling fees, or an additional processing fee may apply.

All shipping charges are non-refundable.

Once merchandise has been accepted for refund, credit will be applied to the account through which payment was originally made within four (4) weeks of receipt, however, in many cases a refund may occur more quickly. This time frame includes time for receiving returned items as well as processing return request.

All refunds will be subject to the following restocking fee to cover the expense of returns:

A restocking fee equal to 30% of the total purchase price.
